DankGraphics 3D – TERMS OF USE (Authorized Seller Agreement)

The following terms and conditions (the “Terms of Use”) constitute a binding agreement between you and DankGraphics 3D, LLC (“DankGraphics 3D,” “DG3D,” “we,” or “us”) with respect to your use of all DankGraphics 3D, LLC-owned websites and domains including dank.graphics (collectively, the “Site”), and the products and designs available on the Site (collectively, the “Offerings”), including any Content (as defined in Section 2 below).

BY CLICKING “I AGREE” OR BY OTHERWISE ACCESSING OR USING THE OFFERINGS, YOU (A) ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THESE TERMS OF USE, AND (B) AFFIRM THAT YOU ARE AT LEAST 18 YEARS OF AGE (OR HAVE REACHED THE AGE OF MAJORITY IN YOUR JURISDICTION). If you do not agree to these Terms of Use or our Privacy Policy, do not use the Offerings. You may not begin to use the Offerings for commercial purposes until DankGraphics 3D, LLC has provided you with an Authorized Seller Badge, which occurs upon acceptance of these Terms and completion of the Authorized Seller Agreement.

1. Changes to Terms of Use

We may revise and update these Terms of Use from time to time at our sole discretion. All changes are effective 30 days after posting for current users and immediately for new users. Your continued use of the Offerings following the posting of revised Terms of Use means that you accept and agree to the changes.

2. Scope of and Restrictions on Use

DankGraphics 3D, LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the Offerings for personal or legitimate business purposes. This includes graphics, text, STLs, 3MFs, and other materials (collectively, the “Content”). Content may not be copied, redistributed, or modified without express written permission.

You agree not to:

  • Use automated means to access or "flood" the Site or systems.

  • Modify or delete any copyright, trademark, or proprietary notices.

  • Employ outside mass production or print-on-demand services. All prints must be produced on 3D printing equipment owned by you.

  • Use DankGraphics 3D, LLC product images. Authorized Sellers must supply their own photography. Use of our images is prohibited except for the provided Authorized Seller Badge.

  • Sell on Drop-Shipping or Mass Wholesaling platforms. This includes, but is not limited to: TEMU, Alibaba, AliExpress, etc.

3. Subscription Services

Our subscription service (e.g., via Patreon) is an automatic recurring service. BY REGISTERING, YOU AUTHORIZE DANKGRAPHICS 3D, LLC AND OUR THIRD-PARTY PROCESSORS TO AUTOMATICALLY CHARGE YOUR PAYMENT METHOD on a recurring basis at the then-effective rate for your plan. You acknowledge that DankGraphics 3D, LLC will not obtain additional authorization for these recurring payments.

4. Ownership and Intellectual Property

The Offerings and Content are owned by DankGraphics 3D, LLC and protected by U.S. and international laws.

  • Commercial Rights: You may only sell physical 3D models (“Models”) while maintaining an active subscription to the commercial tier level.

  • Badge Requirement: You must display your Authorized Seller Badge on every online listing or visible at physical points of sale.

  • Modifications: If you modify the Models, DankGraphics 3D, LLC remains the sole owner of the base design and all modifications. You hereby assign all right, title, and interest in such modifications to DankGraphics 3D, LLC.

5. Account Security

You are responsible for all activities conducted through your account. You may not share your account or credentials with others. You agree to immediately notify DankGraphics 3D, LLC of any unauthorized use or security breach.

6. Submitted Ideas

Any comments, suggestions, or ideas offered to us shall be deemed non-confidential and non-proprietary. DankGraphics 3D, LLC is free to use such information without compensation or acknowledgment.

7. Change and Suspension

DankGraphics 3D, LLC reserves the right to modify, suspend, or discontinue the Offerings at any time. We may deny or terminate your access for any reason, including violation of these Terms. Upon termination, you must immediately stop selling physical Models.

8. Disclaimer; Limitation of Liability

THE OFFERINGS ARE PROVIDED “AS IS.” DANKGRAPHICS 3D, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. In no event shall DankGraphics 3D, LLC or its officers be liable for direct, indirect, or consequential damages exceeding the total fees paid by you to us in the 12 months preceding the claim, or $100.00, whichever is less.

9. Indemnification

You agree to indemnify and hold DankGraphics 3D, LLC and its officers harmless from any claims, damages, or expenses (including attorneys' fees) arising from your use of the Offerings, your sale of Models, or your violation of these Terms.

10. Miscellaneous

  • Governing Law: These Terms are governed by the laws of the State of Michigan. Any litigation shall be brought in the appropriate courts serving Owosso, Michigan.

  • Entire Agreement: These Terms constitute the entire agreement between you and DankGraphics 3D, LLC regarding this subject matter and supersede all prior agreements.
